Performing inactive level actions while a fleet is being upgraded?

I think I may have found a loophole regarding actions a military fleet can perform while being upgraded.
According to the rules a fleet needs to be inactive and remain in the same sector as its home port for the duration of the upgrade at the risk of losing spent resources. There are, however, two actions that can be performed while maintaining these conditions. Piracy patrol and repair.
Now it's possible this was intentional (it can be reasonably explained from an IC point of view), but in case it wasn't I would just like to ask if this is actually allowed or an oversight.

Not the point I'm making here. I'm well aware a fleet can't perform repair and piracy patrol at the same time. My question remains unanswered.
You are right to question this situation! (Now that you've pointed it out, I've even spotted some shennanigans with Attaching armies while upgrading T_T)
It seems that during one of the many reworks, this situation has slipped through the maze. The original idea is that a fleet that is being upgraded can take no other actions.
So, to answer your question: this is a loophole. While upgrading, the fleet should not take strategic actions. I will add clarification to the wiki page on Military Fleets.
